Terms and Conditions

1. Scope of Application

These terms and conditions define the contractual relationship, rights, and obligations between MESA BELLA, registered with the RCS LILLE METROPOLE under number 488 561 762, with its head office at BATIMENT C, 99 RUE DE L'UNION, 59118 WAMBRECHIES, France, and any "consumer" or "professional" purchasing one or more items on the website shop.mesabella.fr.

A "CONSUMER" is defined as "any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity."

A "PROFESSIONAL" is defined as "any natural or legal person, public or private, acting for purposes within the scope of their commercial, industrial, craft, liberal, or agricultural activity, including when acting on behalf of or for another professional."

These general terms and conditions represent the entire agreement between the parties. In this regard, both the consumer and the professional accept them without reservation.

These general terms of sale apply exclusively and prevail over any other general or specific conditions not expressly agreed upon by MESA BELLA.

MESA BELLA reserves the right to modify these terms and conditions at any time without notice. The applicable terms and conditions are those in force at the time of the order.

The CONSUMER and PROFESSIONAL declare that they have the legal capacity to enter into these terms and conditions.

2. Contract Language

These general terms and conditions of sale are written in French.

In the event of translation into one or more foreign languages, the French version shall prevail in case of dispute.

These terms are accessible at any time on the website shop.mesabella.fr, under the "Terms and Conditions" (CGV) section.

By placing an order and concluding the contract, the CONSUMER and PROFESSIONAL acknowledge that they have read and understood these general terms of sale, as well as the information listed in Article L. 221-5 of the French Commercial Code, and expressly accept them without reservation.

These terms are binding under Article 1119 of the French Civil Code and take precedence over any other conditions stated in any other document.

3. Right of Withdrawal

In accordance with consumer protection laws, the CONSUMER has a 14-day withdrawal period, starting the day after receiving the order, to withdraw from the purchase. MESA BELLA will then have 14 days to issue a refund for the order. No returns will be accepted after this period.

The PROFESSIONAL is not entitled to a conventional right of withdrawal.

4. Return Conditions

In the event of withdrawal, the product(s) must be returned in perfect condition, in their original packaging, intact, and complete, allowing for resale in new condition.

Damaged, soiled, or incomplete products will not be accepted.

Returned products must be sent with the delivery note to the following address:

📦 Shipping Risks
The customer bears all risks associated with the return shipment.

The CONSUMER or PROFESSIONAL must check the condition of the package upon arrival. This verification is considered completed once the customer or an authorized person signs the delivery receipt from the carrier.

In case of any issue (missing or damaged product, pierced, opened, or damaged package, particularly with the yellow "La Poste" tape), the CONSUMER or PROFESSIONAL must refuse the package and file a claim within 24 hours with both the carrier and MESA BELLA to initiate an incident report and request a potential refund.

MESA BELLA may request the return of the defective product from the customer.

If the above conditions are met, shop.mesabella.fr will proceed with either:

  • An exchange or refund for defective products, or
  • Reshipping missing products, subject to the validity of the customer's request and product availability.

Return Shipping Costs

  • If the customer made an error (incorrect order, change of mind), they must cover the return shipping costs.
  • If the error is on our part (damaged product, product does not match the product page description), we will provide a prepaid return label by email, and MESA BELLA will cover the return costs.

Products Not Eligible for Returns

MESA BELLA will not accept returns for:

❌ Products without original packaging
