General Terms and Conditions of Sale

Any order placed on shop.mesabella.fr implies acceptance of these general terms and conditions of sale.

1. Scope of Application

These terms and conditions define the contractual relationship, rights, and obligations between MESA BELLA, registered with the RCS LILLE METROPOLE under number 488 561 762, with its head office at BATIMENT C, 99 RUE DE L'UNION, 59118 WAMBRECHIES, France, and any "consumer" or "professional" purchasing one or more items on shop.mesabella.fr.

A "CONSUMER" is defined as "any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity."

A "PROFESSIONAL" is defined as "any natural or legal person, public or private, acting for purposes within the scope of their commercial, industrial, craft, liberal, or agricultural activity, including when acting on behalf of or for another professional."

These general terms and conditions express the entire obligations of the parties. Therefore, both the consumer and the professional accept them without reservation.

These general terms of sale apply exclusively and prevail over any other conditions not expressly agreed upon by MESA BELLA.

MESA BELLA reserves the right to modify these terms and conditions at any time without notice. The applicable terms and conditions are those in force at the time of the order.

The CONSUMER and PROFESSIONAL declare that they have the legal capacity to enter into these terms and conditions.

2. Contract Language

These general terms and conditions of sale are written in French.

In the event of translation into one or more foreign languages, the French version shall prevail in case of dispute.

These terms are accessible at any time on shop.mesabella.fr, under the "Terms and Conditions" (CGV) section.

By placing an order and concluding the contract, the CONSUMER and PROFESSIONAL acknowledge that they have read and understood these general terms of sale, as well as the information listed in Article L. 221-5 of the French Commercial Code, and expressly accept them without reservation.

These terms are binding under Article 1119 of the French Civil Code and take precedence over any other conditions stated in any other document.

3. Products

The products, texts, graphics, and photographs on shop.mesabella.fr are the exclusive property of MESA BELLA. These materials are intended to illustrate the products as accurately as possible in compliance with applicable laws.

MESA BELLA ensures the reliability of the information presented. However, if an error is found, MESA BELLA commits to correcting it as soon as possible.

MESA BELLA ensures that product images are as faithful to reality as possible. However, minor differences may exist due to photographic quality or display settings, and such discrepancies do not constitute grounds for liability if the product conforms to the contract.

4. Guarantees and Compliance

Legal Warranty of Hidden Defects

Under Articles 1641 and following of the French Civil Code, MESA BELLA guarantees the CONSUMER and PROFESSIONAL against hidden defects that could affect delivered products, ensuring replacement or repair of defective products.

MESA BELLA shall not be held liable for any consequential damages caused by such defects.

Legal Warranty of Conformity

In accordance with Articles L. 217-1 and following of the French Consumer Code, MESA BELLA guarantees that products conform to the contract.

The CONSUMER:

  • Has a two-year period from the date of delivery to invoke the conformity guarantee.
  • Can request a repair or replacement of the product, subject to the cost conditions in Article L. 217-9 of the French Consumer Code.
  • Is not required to prove the defect’s existence within 24 months from the delivery date (6 months for second-hand products).

This legal warranty applies independently of any commercial warranty.

If the CONSUMER invokes the hidden defect guarantee under Article 1641 of the Civil Code, they can choose either to cancel the sale or request a price reduction under Article 1644 of the Civil Code.

MESA BELLA is not responsible for improper use of the products outside the manufacturer’s intended usage.

5. Right of Withdrawal

As per the law on the right of withdrawal, the CONSUMER has 14 days from the day after order receipt to withdraw. MESA BELLA has 14 days to process the refund.

⚠️ The PROFESSIONAL does not have a conventional right of withdrawal.

6. Returns

  • Products must be returned in perfect condition, in their original, intact, and complete packaging.
  • Damaged, soiled, or incomplete products will not be accepted.

Return Shipping Costs:

  • If the customer made an error (incorrect order, change of mind), they must cover return shipping costs.
  • If MESA BELLA made an error (damaged or incorrect product), a prepaid return label will be provided.

7. Prices

Prices are in Euros (€) and exclusive of taxes (HT). They are subject to economic conditions at the time of the order.

The total price includes:

  • Product price
  • Handling and packaging fees
  • Shipping costs

MESA BELLA reserves the right to modify prices at any time. The price charged will be that at the time of order validation.

For EU deliveries, the applicable VAT is based on the current rate at the time of order.

8. Order and Payment

📌 Payment methods:

  • Credit or debit card (Visa, Mastercard, Apple Pay, Google Pay).
  • Secure transactions via Shopify Payments.

Orders are processed only after full payment is received.

9. Delivery

  • Orders are shipped only (no in-store pickup).
  • Shipping within 3 business days after order confirmation.
  • Delays do not justify refusal of goods or claims for compensation.

Tracking: Customers receive tracking details via shop.mesabella.fr upon order confirmation.

10. Transfer of Ownership

  • Products remain MESA BELLA’s property until full payment.
  • Risk transfers to the buyer upon delivery.

11. Liability

  • MESA BELLA is not liable for incorrect product usage.
  • MESA BELLA’s liability is limited to the order amount.

12. Intellectual Property

Reproduction or use of any content from shop.mesabella.fr is strictly prohibited without express authorization.

13. Dispute Resolution

  • In case of a dispute, customers should contact MESA BELLA first.
